Supreme Court Ruling Ends IEEPA Tariffs: What Importers Need to Know

On February 20, 2026, the United States Supreme Court ruled, in a 6–3 decision, that the President does not have authority under the International Emergency Economic Powers Act (IEEPA) to impose tariffs. Tariffs implemented under IEEPA are invalid.

The Court determined that while IEEPA allows regulation of imports in response to extraordinary threats, it does not grant tariff-setting authority. If Congress intended to provide such powers, it would have done so explicitly. The ruling applies strictly to IEEPA-based tariffs and does not affect Section 301, Section 232, or other statutory trade mechanisms.

The matter now returns to the U.S. Court of International Trade to determine implementation scope.

What This Means Operationally

At this time, no formal updates to the Harmonized Tariff Schedule have been published, and U.S. Customs and Border Protection has not released full procedural guidance.

Collection suspension and refund mechanisms are anticipated, but official clarification is pending. The broader tariff environment remains active under other legislative authorities.

Disciplined internal review is critical. Importers should identify prior entries tied to IEEPA codes, preserve documentation, and evaluate financial exposure in coordination with customs and legal advisors. Assumptions create risk. Structure creates control.
